1. Acceptance of Terms

By accessing or using the Hermanos application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Important: Hermanos is not affiliated with, endorsed by, or officially connected to Watchtower Bible and Tract Society of Pennsylvania or any related entity. This is an independent tool designed to help congregations manage administrative tasks.

2. Eligibility

To use the App, you must:

  • Be an active member of a Jehovah's Witnesses congregation
  • Be at least 13 years of age, or have parent/guardian consent if under 13
  • Have credentials provided by your congregation elders
  • Accept and comply with these Terms

3. Account Registration and Security

3.1 Account Creation

Accounts are created by congregation administrators (elders or ministerial servants). You will receive login credentials to access the App.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying your congregation administrators immediately if you suspect unauthorized access
  • Not sharing your credentials with others

3.3 Accurate Information

You agree to provide accurate and complete information and to keep your profile information updated.

4. Acceptable Use

4.1 Permitted Uses

You may use the App to:

  • View and manage your congregation assignments
  • Submit field service reports
  • Track territory work
  • Access meeting schedules and congregation directory
  • Communicate with congregation members through App features

4.2 Prohibited Uses

You agree NOT to:

  • Use the App for any unlawful purpose
  • Share congregation data outside your congregation without authorization
  • Attempt to gain unauthorized access to the App or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Use automated systems (bots, scrapers) to access the App
  • Reverse engineer, decompile, or disassemble the App
  • Upload viruses, malware, or harmful code
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations
  • Misrepresent your identity or affiliation

5. User Content and Data

5.1 Your Content

You retain ownership of the content you submit (field service reports, notes, etc.). By submitting content, you grant us a license to store, process, and display it as necessary to provide the App's services.

5.2 Data Accuracy

You are responsible for the accuracy of information you submit, including field service reports. Submitting false information may result in account termination.

5.3 Congregation Data

Information visible to congregation administrators (elders and ministerial servants) is considered congregation data and must be used only for legitimate congregation purposes.

6. Administrator Responsibilities

If you are a congregation administrator with elevated privileges, you agree to:

  • Maintain confidentiality of all congregation member data
  • Use administrative features only for legitimate congregation purposes
  • Respect members' privacy rights
  • Comply with applicable data protection laws
  • Not misuse or abuse administrative access

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, text, graphics, logos, and software, is owned by Hermanos and protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal congregation purposes. This license does not allow you to:

  • Copy, modify, or create derivative works
  • Distribute, sell, or rent the App
  • Remove copyright or proprietary notices

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The App may contain links to third-party websites or integrate with third-party services (map providers, notification services, etc.). We are not responsible for the content, privacy practices, or terms of service of these third parties.

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Availability

We do not guarantee that the App will be:

  • Always available or uninterrupted
  • Free of errors or bugs
  • Secure from unauthorized access
  • Compatible with all devices or operating systems

10.3 Not Official JW Software

This App is not an official product of Watchtower Bible and Tract Society or related entities. It is an independent tool created to assist congregations.

10.4 Data Accuracy

While we strive for accuracy, we do not guarantee that all data in the App is current, complete, or error-free. You are responsible for verifying important information.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • We are not liable for data loss, service interruptions, or security breaches
  • Our total liability shall not exceed the amount you paid to use the App (which is currently free)
  • We are not responsible for actions taken by congregation administrators using the App

12. Indemnification

You agree to indemnify and hold harmless Hermanos, its developers, and service providers from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of the App
  • Your violation of any rights of another person or entity
  • Content you submit to the App

13. Termination

13.1 By You

You may request account deletion at any time by contacting your congregation administrators or our support team.

13.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your congregation administrators request it
  • We discontinue the App
  • Required by law

13.3 Effect of Termination

Upon termination:

  • Your right to access the App ends immediately
  • We may delete your data in accordance with our Privacy Policy
  • Provisions that should survive termination (liability, indemnification, governing law) remain in effect

14. Changes to the App and Terms

14.1 App Changes

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time
  • Add or remove features
  • Change pricing (currently free)

14.2 Changes to Terms

We may update these Terms at any time. We will notify you of significant changes through:

  • In-app notifications
  • Email to your registered address
  • Posting on our website

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App should first be attempted to be resolved informally by contacting suporte@hermanos.site.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hermanos regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.
